Termini di utilizzo
I presenti termini regolano il sito web CueLive, l'area di lavoro del club, le API e il software CueLive Tablet. Creando un account, associando un dispositivo o avviando una pagina pubblica, accetti queste condizioni.
Questa traduzione è fornita a solo scopo informativo. La versione in lingua inglese rimane l'accordo ufficiale e legalmente vincolante.
1. The service (Software only)
CueLive is a cloud software platform that enables licensed billiard tables to publish real-time scores, match history, public club profiles, scoreboard video HUD overlays, and optional live broadcasts. We provide software only. We do not manufacture, sell, distribute, or rent tablets, cameras, mounts, hubs, or network equipment, and we do not operate your physical club venue.
Public pages (live scoreboard, clubs, matches, players) display information entered or published by clubs and players during matches. We may enhance, modify, or adjust software features as the platform develops.
2. Eligibility and accounts
You must be old enough to form a legally binding contract where you reside and maintain the confidentiality of your login credentials. Club workspace access is intended for authorized venue staff. You are responsible for all activity conducted under your account, every paired tablet device, and all scores entered via the tablet interface or CueLive Remote.
We reserve the right to suspend or terminate accounts that breach these terms, fail to settle required license fees, or are used to compromise the integrity of the service, other users, or third-party platforms.
3. Licenses, billing, and cancellations
Each physical billiard table that goes LIVE requires an active CueLive license seat. Club plans are billed per active physical table. Personal player plans are strictly for private tables at home. Players visiting a licensed club table do not pay CueLive to appear on the scoreboard.
Paid plans are ordered through CueLive and activated upon confirmation of payment (including bank transfer). A 14-day free trial is available for one table with no credit card required. Prices and table seat counts are clearly stated prior to order confirmation.
Once a paid subscription period has been provisioned and activated, payments are non-refundable for unused portions of the term, except where non-waivable statutory consumer protection laws apply. When a license period lapses without renewal, existing match records and public club profiles remain permanently preserved; only the capability to initiate new LIVE matches is paused until renewed.
4. Your own equipment & hardware liability disclaimer
CueLive supplies software only. All physical hardware—including Android tablets, webcams, RTSP IP cameras, ceiling mounts, USB hubs, power delivery supplies, and local network cables—is purchased, owned, and maintained independently by you from third-party retailers of your choice.
You are solely responsible for selecting appropriate hardware, installing it securely in your venue, powering it safely, and maintaining your local Wi-Fi or Ethernet network. Any hardware guides, specifications, or model suggestions published on CueLive (including our Equipment Guide) are provided strictly for general informational guidance, do not constitute a warranty or commercial guarantee of fitness for a particular purpose, and are not an endorsement of any manufacturer.
To the fullest extent permitted by applicable law, CueLive disclaims all liability for any physical damage, hardware failure, thermal degradation, lithium battery swelling or fire hazards, power surge damage, camera drops, or device malfunction resulting from 24/7 continuous power or operation in your venue. We strongly advise all operators to enable manufacturer battery health safeguards (such as Samsung Protect Battery 85% limit or Lenovo Battery Protection Mode) and ensure secure structural mounting.
5. Streaming, YouTube API Services, and Google policies
Live video broadcasting is entirely optional. Scoreboards, session billing, waiter calls, and match tracking operate completely without cameras or video feeds. If you choose to connect a YouTube channel to your club:
- You must hold the legal right to stream to that channel and broadcast the visual and audio feeds originating from your venue.
- Your use of YouTube streaming is governed by the YouTube Terms of Service and YouTube Community Guidelines. CueLive’s integration with YouTube API Services is subject to the YouTube API Services Terms of Service.
- Video encoding is executed locally on your tablet device and streamed directly to your connected YouTube channel. CueLive does not store, archive, or retain full video files on our application servers. You retain full control over your YouTube channel and all broadcast replays stored by YouTube.
- You may disconnect YouTube at any time from Club Admin → Streaming, or revoke CueLive permissions directly within your Google Account Security Settings.
- We are not responsible or liable for videos being age-restricted, blocked, demonetized, or removed by YouTube, or for any copyright or community guideline strikes issued against your Google/YouTube account.
6. Venue notice, filming consent, and player likeness
If you operate a camera or public scoreboard in your venue, you are solely responsible for providing prominent physical notice to players and patrons that filming, live streaming, and digital match score recording are taking place.
You warrant and confirm that you have secured all necessary permissions, publicity rights, and releases from every player, referee, club staff member, and identifiable spectator appearing in your streams or photos, including their image, voice, and likeness rights. You must comply with all applicable local privacy, data protection, and child protection regulations (including parental consent for minor competitors). CueLive provides technical software tools only and is not the publisher or producer of your video content.
7. Match scores, statistics, and no-wagering disclaimer
Digital scores, session timers, ball tracking counters, and player statistics generated by CueLive are provided for recreational, informational, and venue administrative purposes only. CueLive is not an official sporting federation, referee, or adjudicating body, and does not arbitrate match disputes or referee calls.
Match results, statistics, and live scores produced by CueLive must not be relied upon for official tournament prize disputes, wagering, commercial betting, gambling, or financial contracts. CueLive disclaims all liability for any financial loss, disputed bets, or prize pool disagreements arising from scorekeeping inputs or technical latency.
8. Acceptable use
You agree not to:
- probe, scan, overload, or attempt unauthorized access to CueLive APIs, servers, or other customer workspaces;
- distribute your club operator logins or tablet pairing PINs outside your authorized staff;
- broadcast copyrighted background music, television broadcasts, or commercial media without appropriate public performance licensing;
- publish or stream defamatory, obscene, harassing, or unlawful content;
- stream individuals where local law requires consent that has not been obtained;
- misrepresent CueLive as selling hardware or guaranteeing YouTube viewership or advertising revenue;
- use CueLive in connection with unlicensed gambling or activities prohibited by law.
9. Intellectual property and user content
The CueLive platform, tablet software, branding, trademarks, code, and visual interface are the intellectual property of CueLive and its licensors. You retain full ownership of your club name, logos, and uploaded assets. You grant CueLive a non-exclusive, worldwide, royalty-free license to host, display, and format your club branding and match records solely as necessary to operate the service (public web pages, score overlays, and workspace views).
If you believe content hosted on CueLive infringes your copyright, notify us at hello@cuelive.tv with the specific URL, your contact details, and proof of rights holder authorization. We respond promptly to valid intellectual property notices.
10. Disclaimer of warranties & best-effort delivery
To the fullest extent permitted by law, CueLive is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, statutory, or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Live streaming and real-time score synchronization depend fundamentally on third-party factors outside our control, including venue Wi-Fi stability, internet service provider upload speeds, camera hardware, and YouTube API uptime. We do not guarantee that any match stream will be uninterrupted, error-free, or broadcast without dropped frames, and we are not liable for degraded, interrupted, or missing video streams.
11. Limitation of liability
To the maximum extent permitted by applicable law, CueLive, its founders, directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, tournament prize pools, business opportunities, goodwill, or data, however caused.
Our total cumulative liability for all claims arising out of or related to CueLive or any subscription order is strictly limited to the total fees actually paid by you to CueLive in the three (3) months preceding the event giving rise to the claim (or €100 if you have used only free trial services). Nothing in these terms excludes liability that cannot lawfully be limited under mandatory consumer protection law.
12. Indemnification
You agree to defend, indemnify, and hold harmless CueLive, its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal and attorney fees) arising out of or in connection with: (a) your use or misuse of CueLive; (b) any match video, audio, photograph, or content streamed from your venue; (c) any failure to secure player or spectator consent under Section 6; (d) any copyrighted music or media broadcast from your room; or (e) your violation of these Terms or applicable laws.
13. Events outside our control (Force majeure)
CueLive is not liable for any failure or delay in performing its obligations where such failure results from events beyond our reasonable control, including internet backbone failures, cloud host outages, local power failures, government actions, platform changes by Google or YouTube, strikes, cyberattacks, or natural disasters.
14. Changes to these terms
We may update these terms periodically to reflect software enhancements or regulatory requirements. The “Last updated” date at the top will indicate the latest revision. Continued use of CueLive following an update constitutes acceptance of the revised terms.
15. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of the Republic of Albania, without regard to conflict-of-law principles. The courts of Tirana, Albania shall have exclusive jurisdiction over any disputes, subject to any mandatory statutory consumer rights in your jurisdiction.
Questions regarding these terms should be addressed to hello@cuelive.tv. For data protection details, see our Privacy Policy.
